Artur Mas fulfilled his threat yesterday and announced the holding of an independence referendum in Catalonia on November 9. The Government, which was prepared for this challenge, is clear about what its action should be: it will maintain a low profile, waiting for the next movements of the 'president' and, if in the end he persists in the consultation, apply article 155 of the Constitution. As government sources and PP leaders explain to El Confidencial Digital , the Executive is going to take “maximum caution” in its response to the call for a referendum announced by Mas. Alfonso Alonso, Jesús Posada and Alberto Ruiz-Gallardón agreed in pointing out that the Government “guarantees that the consultation will not be held”, as it is “illegal” and, therefore, “impossible to carry out”. Mariano Rajoy himself took advantage of a press conference at La Moncloa to remember that “no autonomous government can deprive Spaniards of what the Constitution and the laws guarantee them.

The TC will prohibit the consultation Although Artur Mas has announced the holding of his independence referendum on November 9, the consultation is not yet “official”, as the Generalitat has not published it in the Official Gazette of the Community. Once this communication is produced, the Government will present an appeal before the Constitutional Court . According to Government sources, the TC, which can also act ex officio, will declare the consultation unconstitutional, for violating, among others, article 1 of the Magna Carta, in its sections 2 and 3 , referring to the “national sovereignty of all the Spanish people”, and “the indissoluble union” of the Nation. Once the consultation is declared unconstitutional, it will be prohibited and cannot be carried out, as representatives of the Government and the PP declared yesterday. Article 155 will be applied if the Generalitat calls it As anticipated in these pages, if the Generalitat ignores the prohibition of the Constitutional Court and chooses to call the referendum, the Government will act accordingly and apply article 155 of the Constitution . The article establishes that, if an Autonomous Community fails to comply with constitutional obligations, or acts in a way that "seriously violates the general interest of Spain", the Government can directly intervene in the autonomy.
